Parking Time - General Terms and Conditions

These terms govern the use of all services provided by Parking Time Sweden AB (Parking Time), 559315-7547, to users (individuals over 18 years old) and parking operators (legal entities) in Sweden. For services that have specific terms, the specific terms of the service shall take precedence over these general terms.

Parking Time is a digital parking disc that helps users easily park in places that require a parking disc. It is offered to users via an app for mobile phones with Android and iOS operating systems, and to our customers via a BackOffice web for managing parkings and parking zones.

Parking Time does not offer parking spaces on its own, but all parking takes place under the conditions (in addition to Parking Time's terms) that the respective parking operator specifies on signs at the parking lot.

1. Approval and Consent

These terms are accepted by users when using the app, and by parking operators when using the BackOffice web. The user thereby consents to the processing of personal data as described below. These terms apply both when Parking Time is the data controller and the data processor.

2. Use of Personal Data

Parking Time collects and processes personal data to provide, manage, and charge for its services.

For using the app, only the vehicle registration number (license plate number) is required. The user's position is collected (if the user explicitly allows it) and saved during the parking and for a short time thereafter, to offer the user good functions during parking and a receipt/proof of parking in case of a dispute over parking fines.

For registering a user account for parking, monitoring, and BackOffice, only an email address is required. Other personal data can be registered (name, phone number, personal identification number) for easier contact with the user and for verifying the person's identity.

Additional personal data can be retrieved from the population register and the road traffic register, to the extent necessary to offer secure and easy-to-use services.

Parking Time shares personal data with parking operators for the land where the user parks, for follow-up and parking control, and also via third parties. The personal data provided by the user to Parking Time is never disclosed to third parties for marketing. However, anonymized statistical information can be disclosed to third parties by Parking Time.

3. App Features

Parking Time's app offers users functions to find parking spaces, and to start, manage, and end parking. During ongoing parking, the user sees the end time and receives reminders in the app before the parking time expires.

Parking Time has the right to block the use of the app for a specific registration number, email address, phone number, or personal identification number in case of misuse.

4. Fees and Payment

Use of Parking Time's app is free for users, but with agreed fees from parking operators.

5. Data Protection and Security

Parking Time handles users' and parking operators' data on secure servers and with secure encrypted communication with the app.

Parking Time stores and manages personal data and other parking information only as long as necessary to provide the services to users and to comply with laws and agreements. All personal data is deleted no later than 15 months after they were last needed for these reasons. User accounts therefore become unusable no later than 15 months after last use.

6. Disclaimer of Liability

Users use Parking Time's app at their own risk. Parking Time is not responsible for any losses or damages due to the use, unless otherwise provided by Swedish law. Users must follow the applicable road markings and other signage regarding the conditions for parking.

Parking Time's maps of parking zones are intended to help find parking opportunities and do not necessarily indicate the exact boundaries of the parking areas; the user must always check the signage on site.

Parking Time's servers have very high availability, but temporary interruptions may occur. When this happens, the user is responsible for finding another way to register the parking.

7. Users' Rights

Parking Time follows the provisions of the Data Protection Act and the General Data Protection Regulation (GDPR) regarding users' rights. Users can exercise their rights by contacting Parking Time's support, see contact details at the end of these terms. Users have the right to

  • receive information about what personal data Parking Time has stored about them, after confirmation that the request is made from the identity (email address, phone number, or personal identification number) that registered the personal data. Requests with confirmed personal identification number can concern personal data without time limitation. Requests from email addresses can only concern personal data that has been registered in the last 6 months, as email addresses can be transferred to another person. Requests from phone numbers can only concern personal data that has been registered in the last 3 months, as phone numbers can be transferred to another person.
  • have incorrect personal data corrected, but not incorrectly provided registration numbers for vehicles, or other information about completed parkings.
  • have all personal data deleted that does not need to be retained by Parking Time to comply with laws and agreements.
  • opt out of all future marketing from Parking Time.
  • have personal data exported to standard file format for use with another company. Parking Time stores very few such personal data, and they can therefore easily be retrieved with a screenshot from the app.

The following rights are fulfilled by the description in these terms:

  • The right to know what personal data is collected, the purpose of the processing of personal data, and which other parties may receive the personal data.

After a parking has started, it cannot be canceled, but it can usually be ended early. In some parking zones, however, there is a one-minute right of withdrawal.

8. Users' Obligations

Users shall

  • Protect the app (mobile phone) from unauthorized use
  • Protect passwords from unauthorized access and immediately notify Parking Time if the password is suspected to have been disclosed
  • Ensure that the mobile phone has a working Internet connection
  • Register correct personal data, and without undue delay update this information in case of changes
  • Enter the correct parking zone and registration number (license plate number) when parking
  • Be aware that a parking has started or ended only when a confirmation of it has been received in the app
  • Follow applicable regulations for parking spaces. In many parking zones, a grace period is applied that prevents a new parking from starting within 30 minutes after the maximum parking time has been reached.
  • Use another way to register the parking if Parking Time's app temporarily does not work, regardless of the reason.
  • Contest fines by contacting the parking surveillance whose contact details are always on the ticket. Parking Time can only assist with proof that the parking has been registered between start time and end time, for a specific registration number.
  • Not gain undue advantages by misusing Parking Time's app, or by technical measures trying to circumvent Parking Time's protection for data and parking registrations.

9. Changes to These Terms

Parking Time has the right to update these terms at any time. Such changes shall be announced via a news item on www.parkingtime.se and the latest version of these terms shall always be published on that website.

Users who do not want to be bound by the changed terms must notify Parking Time within a reasonable time, and at the same time request that Parking Time deletes all personal data according to section 7 of these terms.

10. Transfer of Parking Time's Rights

Parking Time has the right to transfer all rights and obligations under these terms to a third party in their entirety. This may occur, for example, in the event of the acquisition of Parking Time. Such transfer shall be notified without undue delay via a change to these terms according to section 9.

Parking Time has the right to transfer parts of its obligations under these terms to a third party, to streamline its processes for offering apps and services to users or parking operators. Such transfer shall be notified without undue delay via a news item on www.parkingtime.se and the latest version of these terms shall always be published on that website.

11. Intellectual Property Rights

Parking Time owns all intellectual property rights related to its services and apps. Users are not permitted to use functions or source code for Parking Time's websites or apps beyond what is offered via their user interfaces.

12. Applicable Law and Disputes

Parking Time follows all recommendations of the Swedish National Board for Consumer Disputes, www.arn.se.

All disputes between Parking Time and its users shall be resolved in accordance with Swedish law. Disputes that cannot be resolved through dialogue between the parties shall be decided by the Stockholm District Court, unless otherwise provided by Swedish law.

This section 12 shall apply even after users have ceased all use of Parking Time's services and apps.
